Welcome to Govah. These Terms of Service ("Terms") govern your access to and use of the Govah mobile applications, website, and related services (collectively, the "Platform"). By using the Platform, you agree to be bound by these Terms. If you do not agree, please do not use our services.

1. Acceptance & Eligibility

By accessing the Govah Platform, you represent that you are at least 18 years of age and have the legal capacity to enter into a binding agreement. You agree to use the Platform in compliance with all applicable local, provincial, and national laws of South Africa.

2. Description of Services

Govah provides a technology platform that enables users to arrange and schedule mobility and logistics services, including:

Govah Solo: Private on-demand ride-hailing.
Govah Share: Corridor-based shared taxi and shuttle services.
Govah Send: On-demand parcel delivery and logistics.

Govah is a technology provider and does not provide transportation services directly. The transportation services are provided by independent third-party contractors (Drivers) who are not employees of Govah.

3. User Accounts

To use most aspects of the Platform, you must register for and maintain an active personal user account. You are responsible for all activity that occurs under your account and agree to maintain the security and secrecy of your account username and password at all times.

Drivers are subject to additional verification, including biometric liveness detection, background checks, and vehicle inspections. Any attempt to spoof identity or bypass safety protocols will result in permanent account termination.

4. Payments, Fees & Wallet

You understand that use of the services may result in charges to you. Govah will facilitate your payment of the applicable charges on behalf of the Driver or Service Provider.

Govah Wallet: You may load funds into your digital wallet for seamless payments. Wallet balances are non-refundable but can be used for any service on the Platform.
Dynamic Pricing: Charges may increase during times of high demand in specific geographic areas or corridors.

5. Prohibited Conduct

You agree not to:

Use the Platform for any unlawful purpose or to transport illegal goods.
Harass, threaten, or cause physical harm to any Driver or fellow Passenger.
Attempt to circumvent the Platform by arranging "off-platform" trips with Drivers met through Govah.
Damage the Driver's vehicle or any property during a trip.

6. Safety & SOS Features

Safety is our priority. The Platform includes real-time telemetry tracking and an in-app SOS panic button. By using the Platform, you consent to the collection of GPS data during your trip. In the event of an emergency, Govah may share your location and account details with emergency responders or security partners.

7. Intellectual Property

All rights, title, and interest in and to the Platform (excluding content provided by users) are and will remain the exclusive property of Govah Mobility Systems. You may not decompile, reverse engineer, or attempt to derive the source code of the applications.

8. Limitation of Liability

Govah shall not be liable for indirect, incidental, special, or consequential damages, including lost profits or personal injury, related to or in connection with the use of the services. While we vet all partners, the quality of the transportation service is ultimately the responsibility of the third-party Driver.

9. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.

10. Cancellation Policy

Govah aims to provide a reliable service for both riders and drivers. To maintain this reliability, we have implemented the following cancellation policy:

Rider Cancellations: If you cancel a Govah Solo or Govah Send request more than 2 minutes after a driver has accepted the request, a cancellation fee may apply. For Govah Share, cancellations made after the corridor departure time has been confirmed may result in a full fare charge.
No-Show Policy: If a driver arrives at the pickup location and waits for more than 5 minutes (Solo) or 2 minutes (Share) without the rider appearing, the driver may cancel the trip, and a "No-Show" fee will be charged to your account or wallet.
Driver Cancellations: If a driver cancels a trip after acceptance without a valid reason, you will not be charged, and we will attempt to re-match you with another driver immediately.

11. Refund Policy

Refund requests are handled on a case-by-case basis by our support team. Our general principles include:

Service Failures: If a technical error on our platform results in a double charge or a charge for a trip that never occurred, a full refund will be issued to your Govah Wallet or original payment method.
Wallet Balances: Funds loaded into the Govah Wallet are generally non-refundable and must be used for services on the platform. In exceptional circumstances (e.g., account closure due to relocation), a refund may be processed minus an administrative fee.
Dispute Timeline: Any refund request or payment dispute must be submitted via the Help Center or to [email protected] within 48 hours of the transaction in question.
